Terms of Service

1. Agreement to these terms

These Terms of Service are between you and Ben Tomlin trading as LTC Magic. They govern your access to and use of LTC Magic, including the Mac application, licensing service, documentation, update feeds, checkout flow, and support channels.

By downloading, purchasing, activating, or using LTC Magic, you agree to these terms. If you are using LTC Magic on behalf of a company, studio, production, or other organisation, you confirm that you have authority to accept these terms for that organisation.

2. Software license

After purchase or trial approval, LTC Magic grants you a limited, non-exclusive, non-transferable, revocable license to install and use the software for professional audio, editorial, and post-production work.

Unless we agree otherwise in writing, each paid license may be activated on up to two Macs at the same time. You are responsible for keeping your license key secure and for activity that occurs through your key.

  • You may use LTC Magic for commercial client work and internal production work.
  • You may keep backup copies of the installer or app for your own use.
  • You may not share, resell, sublicense, publish, or redistribute license keys.

3. Trial access and activation

Trial access is intended to let you evaluate LTC Magic in your own workflow before purchase. Trial duration, eligibility, and activation limits may change over time.

The licensing service may validate license status, activation count, product entitlement, and machine identifiers to prevent abuse and keep purchased licenses working as expected.

4. Acceptable use

You agree not to misuse LTC Magic, the licensing service, or related infrastructure. This includes attempts to bypass licensing checks, interfere with service availability, or use the product in a way that violates applicable law or third-party rights.

  • Do not reverse engineer, decompile, or attempt to extract source code except where applicable law expressly allows it.
  • Do not remove, alter, or bypass activation, signing, update, or security mechanisms.
  • Do not upload malicious requests, automate abusive traffic, or probe private admin/API endpoints.
  • Do not represent LTC Magic as your own product or use our branding in a misleading way.

5. Updates, compatibility, and support

We may release bug fixes, compatibility updates, security updates, and feature changes. Some updates may be required for continued compatibility with macOS, licensing, or update infrastructure.

Support is provided by email on a reasonable-efforts basis. We aim to help with activation, checkout, installation, and product workflow issues, but we cannot guarantee resolution for every hardware, operating system, or third-party application configuration.

6. Payments, taxes, and refunds

Purchases are processed by Stripe or another payment processor we identify at checkout. Prices may include or exclude taxes depending on your location and the checkout configuration shown at the time of purchase.

Refund eligibility is described in our Refund Policy. Approved refunds deactivate the related license and may clear associated activations.

7. Your media and production files

LTC Magic is designed as a local-first Mac application. The core audio processing workflow runs on your Mac. Your audio files, project files, timeline exports, and generated production artifacts are not uploaded to our licensing server as part of normal app use.

You are responsible for maintaining backups, checking generated metadata/timelines, and validating outputs before delivery, archive, broadcast, or client handoff.

8. Intellectual property

LTC Magic, including the software, documentation, website, product design, branding, and licensing infrastructure, is owned by us or our licensors and is protected by intellectual property laws.

These terms do not transfer ownership of LTC Magic to you. You retain ownership of your audio, project files, metadata, edits, and other production materials.

9. Disclaimers and limitation of liability

LTC Magic is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, production delays, missed delivery deadlines, or business interruption.

Nothing in these terms limits liability that cannot be limited by law, including liability for fraud or fraudulent misrepresentation.

10. Suspension and termination

We may suspend or terminate access to licensing services or deactivate a license if we reasonably believe there has been license abuse, payment fraud, chargeback fraud, security misuse, or a material breach of these terms.

You may stop using LTC Magic at any time. Sections that by their nature should survive termination, including payment obligations, restrictions, intellectual property, disclaimers, and liability limits, will continue to apply.

11. Changes and contact

We may update these terms when the product, law, or business changes. The "last modified" date shows when the current version took effect. Continued use after an update means you accept the updated terms.
